Independent Review of Selected Clinical Negligence Matters

Clinical negligence claims can involve questions about the standard of care provided, the consequences of an alleged failing and whether a particular outcome can reasonably be attributed to the treatment or event in question. YT Medical considers selected Clinical Negligence Expert Witness instructions involving hair loss, scalp conditions, hair restoration and related areas that fall within the expert’s professional competence.

The role of the expert is independent. An expert does not determine whether a legal claim succeeds and should not approach a case with the objective of supporting either the claimant or defendant. Instead, the available evidence is reviewed objectively and professional opinion is provided only on issues for which the expert has appropriate knowledge and experience.

What May Be Considered?

Instructions may involve allegations concerning the assessment or management of hair loss, hair or scalp treatment, progression of a condition, treatment-related hair loss, complications or the adequacy of advice and follow-up. The precise issues vary considerably from case to case.

Relevant documentation may include consultation records, clinical notes, photographs, treatment protocols, correspondence, blood-test results, previous diagnoses and subsequent medical assessments. Where appropriate, examination of the individual may also contribute information that cannot be obtained from written records alone.

Hair loss itself can have numerous causes, so the chronology is especially important. Genetic thinning, acute shedding, autoimmune alopecia, inflammatory scalp disease and permanent scarring alopecia can all behave differently. An expert opinion must consider reasonable alternative explanations rather than assuming that any deterioration occurring after treatment was necessarily caused by it.

Standard of Care and Outcome Are Different Questions

An unwanted outcome does not automatically establish that care was negligent. Medical and cosmetic procedures can have recognised complications even when they have been performed appropriately, and some conditions progress despite reasonable management.

Equally, the fact that a particular complication is recognised does not by itself establish that all aspects of care were appropriate. The relevant question may include whether assessment, treatment, consent, monitoring or response to a complication met the standard expected within the circumstances.

Where the instruction asks for an opinion on matters outside the expert’s competence — for example, a highly specialised surgical issue requiring assessment by an appropriately qualified surgeon — this boundary should be identified clearly rather than extending an opinion beyond the relevant area of expertise.

Considering Causation

Where a breach of duty is alleged, causation is considered separately. The question may be whether an identified failing caused or materially contributed to the injury being claimed, and what is likely to have happened in its absence.

This can be particularly important in hair-loss cases because some conditions would have continued to progress regardless of the disputed treatment. Medical history, photographs predating the event, previous symptoms and the expected natural course of the condition can therefore become important parts of the analysis.

Where the available evidence does not allow a firm conclusion, the report should explain that uncertainty.

Prognosis and Further Management

Depending on the instruction, an opinion may also be requested regarding prognosis and future treatment. This may include whether hair loss is likely to recover, stabilise or progress, whether follicles appear permanently damaged and what forms of further assessment or management may reasonably be considered.

Any future-treatment opinion must remain within the expert’s area of professional competence and should not be presented as a guarantee of restoration.
